Law?<\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Last Saturday, September 18, the so-called &#8220;Sara Law&#8221; was published in the Official State Gazette. <\/span><a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2024-18934\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Sara Law<\/span><\/a>\u00a0<span style=\"font-weight: 400;\">a relevant modification in the field of cosmetic surgery.<br \/>\nThis law arose as a consequence of the tragic death of Sara, a patient who died after undergoing liposuction performed by a cardiovascular surgeon, which prompted her family to promote this legislative initiative. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Law Sara amends Annex II of Royal Decree 1277\/2003, establishing the general bases for authorizing healthcare centers, services, and establishments.<br \/>\nThis decree regulates, among other aspects, the classification and definition of care units. <\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%9C%E2%80%A6the_specialty_of_Plastic_Reconstructive_and_Aesthetic_Surgery_becomes_a_guarantee_of_safety_for_the_patient%E2%80%A6%E2%80%9D\"><\/span><b>&#8220;&#8230;the specialty of Plastic, Reconstructive and Aesthetic Surgery becomes a guarantee of safety for the patient&#8230;&#8221;<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">medical procedures, including cosmetic surgery.<br \/>\nThe reform responds to the growing demand for cosmetic surgery interventions and the proliferation of new centers offering these services, which has generated the need to establish greater regulatory control and ensure that only qualified professionals perform these interventions. <\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Context_and_Objective_of_the_Law\"><\/span><span style=\"font-weight: 400;\"> Context and Objective of the Law<\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2003-19572\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Royal Decree 1277\/2003<\/span><\/a><span style=\"font-weight: 400;\"> creates a framework to regulate the authorization and operation of healthcare centers and services in Spain.<br \/>\nIts annexes classify medical units, defining the specialties that must have accredited professionals.<br \/>\nIn view of the increase in the number of aesthetic interventions, the need to update these regulations was identified in order to avoid professional intrusion and guarantee the proper qualification of physicians. <\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%9C%E2%80%A6Clinics_hospitals_and_anesthesia_services_have_from_now_on_legal_responsibility_over_who_performs_the_intervention%E2%80%A6%E2%80%9D\"><\/span><b>&#8220;&#8230;Clinics, hospitals, and anesthesia services have from now on legal responsibility over who performs the intervention&#8230;&#8221;<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">In 2022, Congress passed a bill calling for tighter controls on cosmetic surgery, requiring that procedures can only be performed by properly trained and accredited specialists.<br \/>\nThe Sara Act updates the regulations to define more clearly who can perform these procedures. <\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Legislative_Changes_New_Definition_of_Cosmetic_Surgery\"><\/span><span style=\"font-weight: 400;\"> Legislative Changes: New Definition of Cosmetic Surgery<\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The amendment introduced by the Sara Law in Annex II of Royal Decree 1277\/2003 directly affects the definition of the cosmetic surgery unit.<br \/>\nThe key change is that it now specifies that aesthetic surgical treatments can only be performed by physicians with a specialty in Plastic, Aesthetic and Reconstructive Surgery or other medical-surgical specialties that include in their <\/span><a href=\"https:\/\/www.sanidad.gob.es\/areas\/profesionesSanitarias\/formacionEspecializada\/acreditacionUnidadesDocentes\/legislacion\/programasVigor\/home.htm\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">training program<\/span><\/a><span style=\"font-weight: 400;\"> the necessary competencies.<\/span>\u00a0<span style=\"font-weight: 400;\"> Previous text:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">&#8220;U.47<br \/>\nAesthetic surgery: care unit in which a physician specialized in Plastic, Aesthetic and Reconstructive Surgery or another surgical specialist within the scope of his or her respective specialty is responsible for performing surgical treatments, with the purpose of aesthetic body, facial or hair improvement.&#8221; <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\"> Text amended by Law Sara:<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">&#8220;U.47<br \/>\nAesthetic surgery: care unit in which a physician with a specialty in Plastic, Aesthetic, and Reconstructive Surgery or another surgical or medical-surgical specialty in the scope and competencies indicated in the official program of his specialty, is responsible for performing surgical treatments, with the purpose of aesthetic body, facial or capillary improvement.&#8221; <\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Practical_Implications\"><\/span><span style=\"font-weight: 400;\"> Practical Implications<\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">With this modification, the training program of each medical specialty defines the competencies of professionals who can perform cosmetic surgery procedures.<br \/>\nHowever, from the patient&#8217;s perspective, it is still difficult to determine whether a physician can perform cosmetic surgery procedures. <\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%9C%E2%80%A6It_is_practically_impossible_for_the_patient_to_know_the_detailed_content_of_the_training_programs_of_each_specialty%E2%80%A6%E2%80%9D\"><\/span><b>&#8220;&#8230;It is practically impossible for the patient to know the detailed content of the training programs of each specialty&#8230;&#8221;<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">who is attending you is qualified to perform a specific procedure, unless he\/she is a specialist in Plastic, Reconstructive and Aesthetic Surgery, which guarantees this training. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">It is practically impossible for the patient to know the detailed content of the training programs of each specialty, which hinders his or her ability to make informed decisions about the suitability of the physician.<br \/>\nIn this context, the specialty of Plastic, Reconstructive and Aesthetic Surgery becomes a guarantee of safety for the patient. <\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%E2%80%9C%E2%80%A6inspections_by_the_health_services_of_the_autonomous_communities_of_the_centers_that_offer_cosmetic_surgery_should_be_implemented%E2%80%A6%E2%80%9D\"><\/span><b>&#8220;&#8230;inspections by the health services of the autonomous communities of the centers that offer cosmetic surgery should be implemented&#8230;&#8221;<\/b><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>&nbsp;<\/p>\n<h3><span class=\"ez-toc-section\" id=\"Control_Mechanisms\"><\/span><span style=\"font-weight: 400;\"> Control Mechanisms<\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The new regulations also establish the need for additional control systems for physicians from other specialties who perform cosmetic surgery procedures.<br \/>\nThese controls can come from two main sources: <\/span><\/p>\n<p>&nbsp;<\/p>\n<ol>\n<li><span style=\"font-weight: 400;\"> Clinics and hospitals: The centers where the procedures are performed now have a legal responsibility to ensure that the physicians performing the procedures are properly trained according to their training programs.<br \/>\nIn addition, anesthesia services also acquire the obligation to verify the qualifications of the professionals. <\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<ol start=\"2\">\n<li><span style=\"font-weight: 400;\"> External entities: In cases where clinics or anesthesiologists are not required for the performance of the procedures, it is suggested that the health services of the autonomous communities carry out regular inspections of the centers offering cosmetic surgery.<br \/>\nThese control bodies should ensure that the quality and safety standards established by the Sara Law are met. <\/span><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The Sara Law represents an advance in the regulation of cosmetic surgery in Spain, increasing the guarantees for patients and demanding that only professionals with the appropriate training can carry out these procedures, strengthening supervision and control in this sector. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">The collaboration of clinics, hospitals, anesthesia services, and health services of the different autonomous communities is
